| Labor Relations Division Committee Labor Agreements The LRD shall consist of two (2) member contractors from each of the regional areas where the Labor Relations Division negotiates one or more collective bargaining agreements. The regions shall be as determined from time to time by the then current members on the LRD. The LRD shall select from among its members a chairman who will serve a one (1) year term who shall have a seat on the AGC Board of Directors.
The duties of the LRD shall be to coordinate bargaining on behalf of member and non-member contractors, to represent the Division in dealing with labor organizations; to execute collective bargaining agreements on behalf of represented employers; to appoint, change or remove trustees to various jointly trusteed funds created or to which contributions are made pursuant to collective bargaining agreements; to appoint from among represented employers representatives on grievance committees; to make recommendations to the Legislative Committee on matters dealing with Labor Legislation; to direct members of the staff to make representations on behalf of represented employers to state and federal bodies and officers on matters dealing with labor law and policy; to liaise, cooperate and coordinate with other employer organizations performing labor relations function and such other duties as may be reasonably inferable from the foregoing but not inconsistent with any part of the Bylaws of the Chapter.
1. Appoints Committees from among themselves and represented members to conduct negotiations.
2. Represents the Division in all dealings with labor organizations.
3. Executes collective bargaining agreements on behalf of represented members.
4. Appoints, changes or removes trustees to variously jointly trusteed funds created or to which contributions are made pursuant to the collective bargaining agreements.
5. Appoints from among themselves and the represented membership, representatives on the Joint Grievance Committees.
6. Makes recommendations to the Legislative Committee on matters dealing with labor Legislation.
7. Directs members of the staff to make representations on behalf of member contractors to state and federal bodies and officers on matters dealing with labor law and policy.
8. Liaises, cooperates and coordinates with other employer organizations performing a labor relations function and such other duties as may be reasonably inferable from the foregoing but not inconsistent with part of the bylaws of the Chapter.
· Active participation in the negotiation and/or the ratification of all newly negotiated collective bargaining agreements. · Representation in labor negotiations by the AGC labor relations professionals. · Assistance in the resolution of jurisdictional disputes among any of the specified construction labor unions. · Counsel and interpretation of language of the collective bargaining agreements with those trades with which we negotiate. · Representation by the AGC labor relations professionals in grievance, disputes and arbitrations with the unions with which we have agreements. · Access to construction labor leaders in the state and regionally for discussions of mutual interest throughout the terms of collective bargaining agreements. · Advocacy by the labor relations professionals in public forums. · Legal interpretation of state and federal statutes concerning employee matters, representation in administrative proceedings in labor relations matters where appropriate, and referrals to and recommendations of private counsel when required. · Our LRD members serve as trustees on and recommend contractor selections to jointly administered Taft – Hartley benefit fund trusts for the unions with which members have collective bargaining agreements. · Advocate legislative and regulatory change at the state level to improve the regulatory climate to the benefit of all contractors. · Labor relations professionals maintain relationships with other regional labor professionals in the construction industry who negotiate with the same unions that the Division is signatory with. · Members have member only internet access and hard copy distribution to the following documents: a) All collective bargaining agreements and memoranda of agreements for all trades the Association is signatory to. b) Labor Relations Bulletins c) Updated Wage and Benefits summary for all agreements – a handy reference for current rates and benefits along with a summary of key provisions in the collective bargaining agreement.
The LRD, by a majority vote of its members, is authorized to adopt such rules as it may deem necessary for conducting the operation of the Chapter LRD and to change, alter or amend such recommendations from time to time as they may deem necessary provided such rules are not inconsistent with provisions of other bylaws of the Chapter.
