While AGC NYS and others were successful in convincing the Governor and the NYS Legislature of the need for changes to Carlos’ Law such that risks to General Contractors and Construction Managers are more manageable, failure to properly manage the risks can be very problematic. Carlos’ Law seeks to impose potential criminal charges on employers for jobsite accidents involving “serious physical injury” to an “employee.” Along with such a charge comes the potential for significant fines and an order of restitution. AGC NYS has, for this program entitled “Managing the Risks of Carlos’ Law”, assembled panels of Attorneys and Safety Professionals who will discuss the new law, such keys terms “employee” and “serious physical injury” and how to contractually and practically in the field work to mitigate the significant risks associated with this law.
Key topics will include – Introduction of the Law, Discussion of key terms/concepts, Employee, Independent Contractors, Serious Physical Injury, Negligently, recklessly, intentionally, knowingly, Involving vs. Causing, Controlling Contractor Post-Mortem – What should have been done by GC to prevent and defend, Subcontract language, Actions involving the hazard and response to the accident.
