The Regulation of Safety: What to Expect if an Accident Occurs?, NYC

Peckar & Abramson’s Tom Curran (Chair – White Collar and Regulatory Enforcement) will discuss what response to anticipate in NYC should a major accident/incident occur on your jobsite.  He will explore how to be prepared for that response and, more importantly, he will discuss the appropriate approach you should take to the myriad site visits and requests for information and materials.

Topics will include:

• Worker Safety on jobs, like worker wages, is a regulatory priority;
• When a site accident occurs, especially with tragic results, a stream of regulators will descend on the project;
• And, in NYC, this regulatory reaction is comprehensive – it can also be dysfunctional;
• Among the agencies that you can expect:
  – The NYPD
  – The FDNY
  – The Department of Investigation – Working with the DA and the DOB (triple ID)
  – The Department of Buildings – “BEST” working both with DOI and apart from it.
  – OSHA
  The agencies will be working together and separately – you have to address them all;
• They are going to be trying to grab records that you owe to all;
• They will try to interview your employees;
• They will try to interview and seize the records of your Site Safety Manager;
• The time to deal with this reaction to an accident is BEFORE any accident occurs.
