Governor Hochul recently signed into law the Roadway Excavation Quality Assurance Act (S.4887/A.5608). This legislation amends the State Labor Law to extend the application of prevailing wage to include certain utilityprojects involving roadway excavation. Specifically, the new law mandates that utility companies or their contractors/subcontractor pay the prevailing wage on projects where a permit “to use, excavate, or open a street” is required.
